Holiday Lettings – Owner-Operated Properties

1. Introduction
These Booking Terms and Conditions ("Terms") set out the agreement between you, the guest (“you” or “guest”), and Bracken & Stone Ltd ("we", "us", or "our"), the property owner and operator of the holiday accommodation. By booking a stay at one of our properties, you agree to comply with and be bound by these Terms.
2. Booking and Payment
2.1 A booking is confirmed upon receipt of a deposit (usually 25%) and written confirmation from us.
2.2 The remaining balance is due no later than 6 weeks prior to your arrival date.
2.3 For bookings made less than 6 weeks before the arrival date, full payment is required at the time of booking.
2.4 If payment is made by credit card it is subject to a 1.2% fee
3. Cancellations and Refunds
3.1 If you cancel more than 2 weeks before arrival, we will refund your deposit minus a £50 administration fee.
3.2 If you cancel less than 2 weeks before arrival, we regret that no refund can be provided unless we are able to re-let the property.
3.3 We strongly advise taking out travel insurance to cover unexpected cancellations.
4. Guest Responsibilities
4.1 The lead guest must be over 21 years of age.
4.2 The property must be left in a clean and tidy condition. Any damages or breakages must be reported.
4.3 You agree not to exceed the maximum occupancy as stated in the property listing.
4.4 No parties or events are permitted unless agreed in writing in advance.
4.5 No smoking inside the property.
5. Arrival and Departure
5.1 Check-in is from 4:00pm on the day of arrival, and check-out is by 10:00am on the day of departure.
5.2 Late departure may incur additional charges.
6. Access to the Property
6.1 We or our representatives reserve the right to access the property at reasonable times for maintenance or inspection, with prior notice where possible.
7. Liability
7.1 We are not liable for any accidents, injuries, or losses sustained during your stay, except where caused by our negligence.
7.2 You are responsible for your own possessions during your stay.
8. Pets
8.1 Pets are permitted and must be kept under control at all times.
8.2 Guests are responsible for cleaning up after their pets and ensuring no damage is caused.
9. Wi-Fi and Utilities
9.1 Wi-Fi is provided free of charge but we cannot guarantee speed or uninterrupted service.
9.2 Electricity, gas, and water are included in the rental price unless otherwise stated.
10. Force Majeure
10.1 We are not liable for refunds or compensation due to events beyond our control, such as extreme weather, natural disasters, or government restrictions.
11. Governing Law
These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Noise, Conduct, and Events
12.1 Noise monitoring devices may be in use at the property. Excessive noise, disruptive behaviour, or disturbances may result in the guest being contacted or required to vacate the property without refund.
12.2 No parties, events, or gatherings are permitted without prior written approval from Bracken & Stone Ltd. Any unauthorised use may result in immediate termination of the booking.
12.3 The property may not be sub-let under any circumstances. Guest numbers must not exceed those confirmed at the time of booking without prior written permission.
12.4 The owner reserves the right to refuse entry or terminate a stay without refund if guests engage in illegal activity, cause damage, or act in a way that is likely to disturb neighbours or other guests.
12.5 Guests must park in designated spaces and respect neighbouring properties and access routes.
13. Waste, Cleaning, and Amenities
13.1 Guests must dispose of general and recycling waste using the bins provided. Excess waste that does not fit in the bins must be taken away or may incur additional charges.
13.2 The property should be left in a generally tidy condition. If excessive cleaning is required after departure, a supplementary cleaning fee may be charged.
13.3 Where a hot tub is provided, guests are expected to follow the hot tub guidelines in the welcome pack. For the comfort of all, hot tub use is permitted between 8:00am and 10:00pm only.
